Hemp is a variety of the cannabis plant. Hemp is federally legal because it contains 0.3% or less THC (the compound in marijuana products that is responsible for getting people high). 

Marijuana, on the other hand, is simply those varieties of cannabis that contain more than 0.3% THC. 

Products containing that amount of THC can still produce psychoactive effects. Since it is the amount of THC, rather than its effects, that are regulated, this makes it possible to create products, such as Delta 8 or Delta 9 products, that can still get people high in states where marijuana is not legal.
